01 Acceptance of Terms

By accessing usetrackt.app or submitting your information to join the Trackt waitlist, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the site or submit your information.

These Terms apply to all visitors, waitlist members, and future users of the Trackt platform operated by Aaryx AI ("Company", "we", "us", or "our").

These Terms are written in plain language on purpose. If something is unclear, email us at hello@usetrackt.app and we will explain it.

02 What Trackt Is

Trackt is an operational follow-through intelligence product designed to help relationship-driven professionals see commitments at risk, missed follow-ups, unanswered questions, and timing issues before they become business damage. The product is currently in pre-launch.

At the time of these Terms, the only active service is the waitlist signup at usetrackt.app. No software subscription, email scanning, or calendar access is provided or enabled at this stage.

When the product launches, additional terms specific to the software service will be provided at the time of account creation. Those terms will govern your use of the Trackt application itself.

03 Waitlist Terms

By joining the waitlist you agree to the following:

You are providing your contact information voluntarily in exchange for early access notifications
Joining the waitlist does not guarantee access to the product, a specific launch date, or any particular feature set
We will contact you only about Trackt. We will not use your email for unrelated marketing
You can leave the waitlist at any time by emailing privacy@usetrackt.app
We reserve the right to close, pause, or modify the waitlist at any time

Joining the waitlist is not a purchase, contract, or binding commitment from either party. No payment is taken at this stage.

04 Founding Access and Launch Pricing

Joining the waitlist requests founding access consideration. It is not a purchase, reservation, or guarantee of admission.

We may offer early users design partner onboarding, preferred launch pricing, or other founding-member benefits when the product is ready. Any such offer is a stated commercial intention only until a separate subscription or service agreement is presented and accepted.

We reserve the right to adjust launch pricing, access terms, and eligibility criteria before public release. If we make a material change to a founding-access offer after communicating it to you, we will notify affected waitlist members by email before asking for payment or activation.

No payment information is collected through the waitlist form. No charges will be made without your explicit consent at the time of subscription or service activation.

05 Acceptable Use

When using usetrackt.app you agree not to:

Submit false, misleading, or fraudulent information through the waitlist form
Attempt to gain unauthorized access to any part of the site or its infrastructure
Use automated tools or bots to submit multiple waitlist entries
Scrape, harvest, or collect data from the site without written permission
Use the site in any way that violates applicable local, state, national, or international law
Attempt to interfere with or disrupt the integrity or performance of the site
Transmit any unsolicited or unauthorized advertising or promotional material

Violation of these terms may result in removal from the waitlist and being blocked from future access to the platform.

06 Intellectual Property

All content on usetrackt.app including but not limited to text, copy, design, graphics, logos, product names, and code is owned by or licensed to Aaryx AI and is protected by applicable intellectual property laws.

The Trackt name and product concept are proprietary to Aaryx AI. Nothing on this site grants you any right to use our trademarks, trade names, or branding without prior written permission.

You retain ownership of any information you submit through the waitlist form. By submitting it you grant us a limited, non-exclusive license to use that information for the purposes described in our Privacy Policy.

07 Disclaimers

The Trackt waitlist site is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

The site will be uninterrupted, error-free, or secure
The product will launch on any specific date or with any specific features
The founding pricing advertised will remain unchanged through to launch
The site will be free from viruses or other harmful components

We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

Trackt is a pre-launch product. The mock demos shown on the landing page represent intended functionality and are not a guarantee of the final product's capabilities or accuracy.

08 Limitation of Liability

To the fullest extent permitted by applicable law, Aaryx AI and its founders, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

Your use of or inability to use the waitlist site
Any delay in or failure of product launch
Loss of data or unauthorized access to your submitted information
Any errors or omissions in the content on the site

Our total liability to you for any claims arising under these Terms shall not exceed $0, as no payment has been made at the waitlist stage.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the minimum extent permitted by applicable law.

09 Termination

We reserve the right to terminate or suspend your access to the waitlist or site at any time, with or without notice, for any reason including violation of these Terms.

You may remove yourself from the waitlist at any time by emailing privacy@usetrackt.app. Removal from the waitlist does not affect any legal obligations that arose prior to termination.

10 Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles.

Any dispute arising from these Terms that cannot be resolved informally shall be submitted to binding arbitration in Pittsburgh, Pennsylvania, under the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitration are waived to the fullest extent permitted by law.

Before initiating any formal dispute process, we ask that you contact us at hello@usetrackt.app and give us 30 days to attempt to resolve the issue informally.

11 Changes to These Terms

We may update these Terms as the product evolves. When we make material changes, we will notify waitlist members by email and update the "Last updated" date at the top of this page.

Your continued use of the site after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, remove yourself from the waitlist by emailing privacy@usetrackt.app.
